On 10 October 2018, the Netherlands Authority for the Financial Markets (Autoriteit Financiële Markten, AFM) published the following forms in relation to the Money Market Funds Regulation (MMFR) in its Digital Portal:
- an application form to be used by managers of alternative investment funds (AIFs) and undertakings for collective investment in transferable securities (UCITS) to extend their existing licence so that they may also be permitted to manage Money Market Funds (geldmarktfondsen, MMFs); and
- a notification form to be used by managers to notify (their intention to):
- change an existing MMF; or
- manage or offer units in a new MMF.
The notification form can only be used if the AIF or UCITS concerned is already registered with the AFM and included in its public register. In case of a newly established AIF or UCITS qualifying as a MMF, the usual process for registering a AIF or UCITS should be followed.
The MMFR is the new European Union (EU) regulatory framework aimed at ensuring the stability and integrity of MMFs which are established, managed or marketed in the EU. Managers of existing AIFS or UCITS qualifying as MMFs in the Netherlands have until 21 January 2019 to submit a complete application to the AFM.
