On 28 June 2024, the Agency for the Cooperation of Energy Regulators (ACER) launched a public consultation on changes to the Annex of Commission Implementing Regulation (EU) No 1348/2014 on data reporting implementing Article 8(2) and Article 8(6) of Regulation (EU) No 1227/2011 (REMIT Implementing Regulation). By way of background, Regulation (EU) 1227/2011 on wholesale energy market integrity and transparency (REMIT) was recently updated and this included amendments to the scope of data reporting requirements for wholesale energy products (see our note). The European Commission is mandated to review the REMIT Implementing Regulation by 8 May 2025 and the current ACER consultation will feed into this upcoming review.

The purpose of ACER consultation is to collect stakeholders’ views on data collection and data fields for the upcoming revision of the Annex of the REMIT Implementing Regulation. To this end, the consultation covers prospective changes to both the existing Annex tables – including Table 1 (reportable details of standard contracts for the supply of electricity and natural gas), Table 2 (reportable details of non-standard contracts for the supply of electricity and gas), Table 3 (reportable details of wholesale energy products in relation to the transportation of electricity), Table 4 (reportable details of wholesale energy products in relation to the transportation of gas) – as well as new contracts to be included in the Annex. In particular, the latter section includes questions concerning the extension of the REMIT data collection requirement to contracts relating to storage, hydrogen and exposures, as well as changes concerning LNG market data reporting.

The public consultation is open until 6 September 2024.
