On 7 June 2018, the draft Decree implementing the revised Institutions for Occupational Retirement Provision Directive (EU/2016/2341) (IORP II) was published for consultation (Besluit in verband met implementatie van de herziene IORP-richtlijn, the Implementing Decree).

IORP II aims to improve the governance, risk management, transparency, provision of information and to increase cross-border activity of pension funds in relation to occupational retirement provision. Together with the Act Implementing IORP II, the Implementing Decree will implement IORP II into Dutch legislation. The Implementing Decree will amend the following decrees:

• Decree Financial Assessment Framework Pension Funds (Besluit financieel toetsingskader pensioenfondsen);
• Decree Implementation Pension Act and Occupational Pension Scheme Obligatory Membership (Besluit uitvoering Pensioenwet en Wet verplichte beroepspensioenregeling);
• Financial Supervision Funding Decree 2019 (Besluit bekostiging financieel toezicht 2019);
• Decree on Prudential Rules for Financial Undertakings AFS (Besluit prudentiële regels Wft);
• Decree on Conduct of Business Supervision of Financial Undertakings AFS (Decree Besluit gedragstoezicht financiële ondernemingen Wft); and
• Decree on Market Access of Financial Undertakings AFS (Besluit markttoegang financiële ondernemingen Wft).
