On 16 March 2016, the Amendment Decree Financial Markets 2016 (Wijzigingsbesluit financiële markten 2016, the Amendment Decree) entered into force. The Amendment Decree amends, amongst other things, the Decree on Conduct of Business Supervision of Financial Undertakings (Besluit Gedragstoezicht financiële ondernemingen Wft), the Decree on Prudential Rules for Financial Undertakings (Besluit prudentiële regels Wft) the Decree on Administrative Fines in the Financial Sector (Besluit bestuurlijke boetes financiële sector) and the Decree on Market Access of Financial Undertakings (Besluit Markttoegang financiële ondernemingen Wft).
The Amendment Decree is part of an annual cycle of amendments to the laws and regulations relevant for the financial markets. The Amendment Decree provides for, among other things, new rules for crowdfunding platforms and a new rule that prohibits financial services providers from receiving or paying commission for mediation or advice provided in connection with claims on premium pension institutions (premiepensioenvorderingen).
