On 9 August 2016, the Netherlands Authority for the Financial Markets (Autoriteit Financiële Markten, the AFM) published a framework for the purpose of assessing actively managed Exchange Traded Funds (ETFs) and ETFs on an alternative index (the Framework).
At the end of 2015, the AFM conducted an exploratory investigation into managed ETFs and ETFs on an alternative index. The AFM concluded that a wide range of such ETFs (also in terms of complexity and the associated risks) are offered in the Netherlands, some of which may be difficult to understand for the average investor. On the basis of its investigation, the AFM has published the Framework in order to assist asset managers, advisors and fund providers with developing or selecting actively managed ETFs and ETFs on an alternative index, and allowing these parties to carefully consider these categories of ETFs and make comparisons with alternatives in the interest of the customer.
