On 2 May 2017, the Dutch Minister of Finance published for consultation the Decree implementing the Packaged Retail and Insurance-based Investment Products Regulation (PRIIPs Regulation) (Besluit implementatie verordening essentiële-informatiedocumenten) (the Implementation Decree). The Implementation Decree will amend, among other things, the Decree on Conduct of Business Supervision of Financial Undertakings (Besluit Gedragstoezicht financiële ondernemingen Wft, BGfo).
Dutch regulatory law currently provides that a financial leaflet (financiële bijlsuiter) must be provided when complex products are offered. The PRIIPs Regulation will introduce the obligation to instead provide non-professional investors with a Key Information Document (KID) for most complex products. For third-party pension products (derdepijlerpensioenproducten), which are explicitly excluded from the scope of the PRIIPs regulation, a Dutch local law requirement to provide an information document will be introduced in the BGfo. This information document will be based on the KID in terms of layout and contents.
The consultation period will end on 30 May 2017.
