On 28 November 2023, there was published in the Official Journal of the EU Directive (EU) 2023/2673 amending Directive 2011/83/EU as regards financial services contracts concluded at a distance and repealing Directive 2002/65/EC.
The Directive aims to repeal the Distance Marketing Directive (DMD) and transfer the framework for consumer protections relating to financial services distance contracts to the Consumer Rights Directive (CRD). The Directive makes targeted modernising amendments to the DMD framework and extends certain rules in the CRD to financial services distance contracts.
The Directive will enter into force on 18 December 2023 and will apply from 19 June 2026.
Member States must adopt and publish, by 19 December 2025, the laws, regulations, and administrative provisions necessary to implement the Directive.
