On 19 December 2024, the European Banking Authority (EBA) published a Handbook which provides best practices and high-quality methodologies and processes for the selection and appointment of independent valuers for resolution purposes in accordance with Articles 36 and 74 of the Bank Recovery and Resolution Directive. The Handbook identifies best practices for the three elements of independence that the resolution authorities should assess for the valuer in line with the existing regulatory framework, which states that the valuer should: i) possess the necessary qualifications, experience, ability, knowledge and resources; ii) be legally separated from the relevant public authority and the relevant entity; and iii) have no material common or conflicting interest with the relevant public authority or the relevant entity.
