On 27 October 2025, the European Commission (Commission) adopted a Commission Delegated Regulation amending the Regulatory Technical Standards (RTS) laid down in Delegated Regulation (EU) 2018/1645 and Delegated Regulation (EU) 2018/1646.
Overview
Delegated Regulation (EU) 2018/1645 sets out information required when a benchmark administrator located in a third country submits its application for recognition and Delegated Regulation (EU) 2018/1646 specifies the information to be included in the application for authorisation or registration by a benchmark administrator located in the Union.
The Commission Delegated Regulation now adopted by the Commission amends both Delegated Regulation (EU) 2018/1645 and Delegated Regulation (EU) 2018/1646 so that they reflect the changes that were introduced in 2019 to the recognition regime under the Benchmarks Regulation with the transfer of certain supervisory responsibilities to the European Securities and Markets Authority (ESMA) and reducing the regulatory burden on administrators of smaller benchmarks.
The draft RTS in the Commission Delegated Regulation reflects the drafts submitted by ESMA in November 2022 and July 2023.

The Commission Delegated Regulation enters into force on the twentieth day following its publication in the Official Journal of the European Union.
