On 11 June 2025, the European Commission adopted a Delegated Regulation amending Delegated Regulation (EU) No 876/2013 supplementing the European Market Infrastructure Regulation (EMIR) as regards changes to the functioning and management of colleges for central counterparties (CCPs).

The Delegated Regulation makes limited amendments to Commission Delegated Regulation (EU) No 876/2013 so as to align it with the amendments made to EMIR by Regulation (EU) 2987/2024. The amendments to Delegated Regulation (EU) No 876/2013 are as follows:

  • Article 2 of Delegated Regulation (EU) No 876/2013 is amended to reflect the changes introduced in Article 18(1) of EMIR specifying the deadline for establishing a college and the role the co-chairs in the context of the establishment of such college.
  • Articles 3 and 4 of Delegated Regulation (EU) No 876/2013 are amended to reflect the changes introduced in Article 18 of EMIR to clarify the roles of the co-chairs and governance of colleges with a view to ensure the effective and consistent functioning of colleges for all CCPs across the EU.
  • Article 5 of Delegated Regulation (EU) No 876/2013 is amended to clarify what additional information a CCP’s competent authority should provide to college members and that the CCP’s competent authority and the college members should use the central database provided by Article 17c of Regulation (EU) No 648/2012 to exchange any information.

The Delegated Regulation enters into force on the twentieth day following its publication in the Official Journal of the EU.
