On 29 October 2025, the European Commission (Commission) adopted a Commission Delegated Regulation amending Delegated Regulation (EU) 2022/805 as regards fees for the supervision by the European Securities and Markets Authority (ESMA) of benchmark administrators endorsing third country benchmarks.

The draft Delegated Regulation updates Delegated Regulation (EU) 2022/805 to include supervisory fees for the new category of benchmark administrators under the supervision of ESMA, i.e. EU administrators that endorse third country benchmarks.

From 29 July 2025 until 8 September 2025, the Commission consulted the Expert Group of the European Securities Committee on the content of the draft Delegated Regulation. The draft Delegated Regulation was then published on the Better Regulation portal for a four-week feedback period.

The Delegated Regulation enters into force on the day following its publication in the Official Journal of the EU.
