On 5 September 2018, there was published on the legislation.gov website an updated draft EEA Passport Rights (Amendment, etc., and Transitional Provisions) (EU Exit) Regulations 2018 (the SI), together with an explanatory memorandum.
The SI has been laid before Parliament and incorporates changes to the initial draft published on 24 July 2018 (see our extended blog). The majority of the changes in the SI are minor, with the phrasing of certain sections altered, and certain provisions relocated (i.e. the power to amend time limits has been moved from Part 3 to Part 5). New provisions have also been inserted relating to tax and the modification of the Financial Services and Markets Act with regards those persons who cease to be authorised to carry on a regulated activity before exit day. References to certain secondary legislation under Part 3 of the SI have been removed.
