On 29 June 2018, there was published on the legislation.gov.uk website The Financial Services and Markets Act 2000 (Prospectus and Markets in Financial Instruments) Regulations 2018 (the Regulations).

The explanatory memorandum to the Regulations explains that the Regulations make consequential amendments to the Financial Services and Markets Act 2000 (FSMA) in order to implement part of the Prospectus Regulation which applies from 21 July 2018. Specifically, the Regulations implement Articles 1(3) and 3(2) of the Prospectus Regulation by amending section 86 and Schedule 11A to FSMA.

The Regulations also make minor amendments to certain statutory instruments implementing MiFID II in the UK: the Financial Services and Markets Act 2000 (Regulated Activities) (Amendment) Order 2017, the Data Reporting Services Regulations 2017, the Financial Services and Markets Act 2000 (Markets in Financial Instruments) Regulations 2017 and the Financial Services and Markets Act 2000 (Markets in Financial Instruments) (No. 2) Regulations 2017.
