On 9 January 2025, the Financial Services and Markets Act 2000 (Collective Investment Schemes) (Amendment) Order 2025 (the Order) was laid before Parliament and published, along with an explanatory memorandum.
The purpose of the Order is to ensure that arrangements for qualifying cryptoasset staking do not amount to a collective investment scheme for the purposes of section 235 of the Financial Services and Markets Act 2000 (FSMA). It does this by amending the Financial Services and Markets Act 2000 (Collective Investment Schemes) Order 2001 to add qualifying cryptoasset staking to the list of arrangements that do not amount to a collective investment scheme (as set out in the Schedule to that Order).
The Order comes into force on 31 January 2025.
