On 4 April 2019, the FCA published a revised memorandum of understanding (MoU) between itself and the Advertising Standards Authority (ASA). The purpose of the MoU is to facilitate and provide a framework for co-operation between the FCA and ASA by setting out the respective regulatory responsibilities of the FCA and ASA and a framework for co-operation. The MoU relates to the operation both regulators’ respective statutory responsibilities under the Financial Services and Markets Act 2000, the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing, the UK Code of Broadcast Advertising and other relevant legislation.
