The FCA has published the Prospectus Rules (Regulatory Technical Standards) Instrument 2014, which came into force on 5 May 2014.

The instrument amends the Prospectus Rules (PR) to reflect requirements imposed in the European Commission’s Delegated Regulation, which sets out regulatory technical standards for the publication of supplementary prospectuses. The instrument inserts new text after PR 3.4.3R on the minimum situations in which a supplementary prospectus must be submitted for approval.

Additionally, in Handbook Notice no.11, the FCA confirmed that it had not consulted on the changes as they involve the reproduction in the Prospectus Rules of extracts of directly applicable EU legislation and therefore do not constitute a change in FCA policy.
