The Financial Services and Markets Act 2000 (Qualifying EU Provisions) (No 2) Order 2013 has been published along with an explanatory memorandum.
The Order, which was made on 9 December 2013, comes into force on 1 January 2014. The Order specifies directly applicable EU law (the Capital Requirements Regulation) for various purposes under the Financial Services and Markets Act 2000 to allow the PRA and FCA to investigate and bring enforcement action for the breach of designating provisions of EU law.
