The FCA has published Handbook Notice No. 49. In this Handbook Notice, the FCA briefly describes the changes that have been made to the FCA Handbook by the following instruments:
- MiFID II Guide Instrument 2017; and
- Capital Requirements Directive IV (Amendment) Instrument 2017.
The FCA also provides feedback on the following:
- Consultation Papers 15/43 and 16/19: MiFID II Implementation – MiFID II Guide. The FCA reports that in light of the consultation feedback it has received, it has clarified the status of the guide as general guidance and will provide a link to a MiFID II transposition table in due course. It has also broadened the scope of the guidance relating to SYSC to capture specialist firms such as authorised professional firms, UCITS managers and alternative investment fund managers and added signposts in organograms to key rules and regulations; and
- Consultation Paper 17/3: Quarterly Consultation Paper No.18 (Chapter 5 – Change to IFPRU 2.2). The FCA proposed adding a new sentence to IFPRU 2.2.28R(2) to help ensure full implementation of the CRD IV. The FCA reports that there was no feedback and therefore it has made the changes as consulted on.
