The European Long-term Investment Fund Regulation (ELTIF Regulation) creates a regulatory framework for European alternative investment funds and is directly applicable in Member States, However, in the UK some minor amendments to both primary and secondary legislation is needed to make the provisions of the ELTIF Regulation workable in the existing UK regime. The statutory instrument makes those minor amendments including clarifying that it is a criminal offence to mislead the FCA in relation to purported compliance with a requirement imposed by the ELTIF Regulation.
