On 23 June 2023, the European Securities and Markets Authority (ESMA) published two final reports containing guidelines on the Regulation on a framework for the recovery and resolution of central counterparties (CCPRRR). The final reports follow the publication of Commission Delegated Regulations 2023/1193 on the content of resolution plans and 2023/1192 on resolution colleges.
The guidelines cover the:
- Written arrangements and procedures for the functioning of resolution colleges. The aim of the guidelines is to assist in the creation of resolution colleges by establishing a common basis for the written arrangements in the form of a template. This will support the process of swiftly establishing resolution colleges to ensure a smooth process to both establish and review the resolution college agreement.
- Summary of resolution plans. The guidelines provide a template for the summary of a resolution plan. This will enable resolution authorities responsible for drafting the resolution plan to share, in accordance with Article 12(8) of CCPRRR, the information in the plan in a manner that provides the CCP with the information of the key elements as envisaged under Article 12(7) (a) of CCPRRR.
Both guidelines apply after their publication by ESMA on its website in the official languages of the European Union.
