On 25 March 2022, the European Securities and Markets Authority (ESMA) published a final report containing:
- Guidelines that amend the current guidelines on transfer of data between trade repositories (TRs) under the European Markets Infrastructure Regulation (EMIR). The amendments seek to strengthen the existing framework to port records from one TR to another under EMIR. The existing guidelines on data transfer under EMIR apply as of 16 October 2017. The amendments to these guidelines apply as of 3 October 2022.
- Guidelines on transfer of data between TRs under the Regulation on transparency of securities financing transactions and of reuse (SFTR). These new guidelines concern SFTR reporting requirements in the context of porting to set up a framework to enable market participants to safely transfer data from one TR to another under the SFTR. The guidelines apply as of 3 October 2022.
The final report also provides ESMA’s response to the feedback it received to its earlier consultation paper on the above guidelines.
