On 22 March 2019, there was published in the Official Journal of the EU (OJ),:

  • Commission Delegated Regulation (EU) 2019/361 of 13 December 2018 amending Delegated Regulation (EU) No 151/2013 with regard to access to the data held in trade repositories. This amending Delegated Regulation inserts a new Article 2 into Delegated Regulation (EU) No 151/2013 concerning access to details of derivatives in accordance with the responsibilities and mandate of each authority concerned; and
  • Commission Delegated Regulation (EU) 2019/362 of 13 December 2018 amending Delegated Regulation (EU) No 150/2013 as regards regulatory technical standards specifying the details of the application for registration as a trade repository. The amending Delegated Regulation inserts the following new articles into Delegated Regulation (EU) No 150/2013: (i) Article 1(2); (ii) Article 2 (policies and procedures); (iii) Article 7 (internal control); (iv) Article 9 (senior management and members of the board); (v) Article 11 (fitness and properness); Article 12 (financial reports and business plans); (vi) Article 14 (confidentiality); (vii) Article 16 (information technology resources and outsourcing); (viii) Article 17 (ancillary services); (ix) Articles 18, 19 and 20 (transparency of access rules, verification of completeness and correctness of data and pricing policy transparency); (x) Article 21 (operational risk); (xi) Article 22 (recordkeeping policy); (xii) Article 23 (data availability mechanisms); and (xiii) Article 23a (direct and immediate access to data by authorities).

The Delegated Regulations come into force on the twentieth day following their publication in the OJ.
