The European Banking Authority has published a decision regarding the adoption of rules of procedure for the investigation of a breach of Union law. Article 17 of the Regulation establishing the EBA provides for the European Supervisory Authority to investigate the non-application by Member State competent authorities the acts referred to in Article 1(2). Whilst initiating investigations remains within the EBA’s discretion, the rules of procedure set out the factors, criteria and other related matters to be taken into account in relation to requests to initiate investigations that are received from third parties or, to the extent relevant, to EBA own initiative investigations.
