The European Banking Authority (EBA) has published an opinion on the European Commission’s intention to amend the draft regulatory technical standards (RTS) specifying the criteria relating to the methodology for setting the minimum requirement for own funds and eligible liabilities (MREL) in accordance with the Bank Recovery and Resolution Directive. Whilst the EBA accepts a number of changes that ultimately improve the clarity and simplicity of the original wording of the RTS it does reject certain amendments to Article 5. The EBA submits the amended draft RTS to the Commission in the form set out in the Annex.
