On 8 November 2018, the European Banking Authority (EBA) published its final report on confidentiality regimes of third countries with respect to Article 116(6) of the Capital Requirements Directive IV.
The results of the EBA’s assessment of third country confidentiality regimes were first published in recommendations in 2015 (EBA/REC/2015/01), however as the assessment is an ongoing processes – new amending recommendations are required to reflect the outcomes of the new assessments.
The report sets out the following amendments to the 2015 recommendations. Specifically, the report adds to the ‘table of authorities assessed and equivalence assessment performed’:
- Abu Dhabi Global Market;
- Republic of South Korea;
- Republic of Moldova; and
- Hong Kong.
The date of implementation for the recommendations is not specified.
