The European Banking Authority (EBA) has published a decision adopting rules of procedure for the settlement of disagreements between competent authorities as per the requirements of article 41 of the EBA Regulation.

Cases involving disagreements between competent authorities will be examined by a panel which will be composed of members who are neither representatives of the competent authorities in disagreement nor have a conflict or direct links to the competent authorities concerned.

The decision sets out certain general provisions concerning the tasks, composition and appointment of the panel. It also covers how the panel will make decisions and sets out certain ancillary provisions including those concerning confidentiality.
