The European Banking Authority (EBA) has published a decision adopting rules of procedure for investigating a breach of EU law.

Whilst initiating investigations remains at the EBA’s discretion, the rules of procedure set out the factors, criteria and other related matters to be taken into account in relation to requests to initiate investigations that are received from third parties.

The decision came into force on 15 July 2014. It repeals and replaces the EBA decision of 5 July 2012 concerning the internal processing rules on investigation regarding breaches of Union law.
