The OFT has published General Notice No. 97 which relates to the deadline to apply for an extension of the period to pay a charge under section 28A of the Consumer Credit Act 1974 (CCA).

In particular, the General Notice states that in respect of any standard licence where the payment period:

  • ends on or before 27 March 2014, the application must be received by the OFT by 4pm on the last working day of the applicant’s payment period. For these purposes, a working day is any day other than Saturday, Sunday or public holidays; and
  • ends on or after 28 March 2014, the application must be received by the OFT by midnight on 27 March 2014.

Furthermore, the OFT gives general notice pursuant to section 6(2) of the CCA that any application must be made in writing and must set out why the applicant has not paid the charge (or has only paid part of the charge) prior to making the application, and why the applicant cannot pay the charge (or that part of the charge in respect of which they seek an extension) before the end of their payment period.
