There has been published in the Official Journal of the EU Commission Implementing Decision of 1 July 2016 on the equivalence of designated contract markets in the United States in accordance with the Regulation on over-the-counter derivatives, central counterparties and trade repositories (EMIR).

The Implementing Decision provides that, for the purposes of Article 2(7) of EMIR, the boards of trade designated by the Commodity Futures Trading Commission as contract makers in the US and set out in the Annex shall be considered as equivalent to regulated markets as defined in point 14 of Article 4(1)(14) of MiFID.
