On 16 October 2019, the European Commission (Commission) published a Delegated Regulation supplementing the Securitisation Regulation with regard to regulatory technical standards (RTS) specifying the information and the details of a securitisation to be made available by the originator, sponsor and securitisation special purpose entity (SSPE).
Article 7(3) and (4) of the Securitisation Regulation mandates the European Securities and Markets Authority (ESMA) to produce draft RTS and implementing technical standards (ITS) specifying both what information must be disclosed for securitisations and standardised templates for submitting that information. In addition, Article 17(2)(a) and (3) mandates ESMA to draft RTS and ITS specifying the information that must be provided to the securitisation repository.
The Delegated Regulation specifies the information to be made available for all securitisations namely underlying exposures in the securitisation (Article 2), investor reports (Article 3), inside information (Article 6), and significant events that affect the transaction (Article 7). The reporting information on underlying exposures can be found in the annexes.
The Delegated Regulation will enter into force on the twentieth day following its publication in the Official Journal of the EU.
