On 17 June 2022, the European Commission published a Delegated Regulation supplementing the Capital Requirements Directive IV (CRD IV) with regard to regulatory technical standards (RTS) specifying the information to be provided in the application for authorisation as a credit institution, and specifying the obstacles which may prevent the effective exercise of supervisory functions of Member State competent authorities.

The Delegated Regulation specifies:

  • Information to be provided to Member State competent authorities in the application for the authorisation of credit institutions, including the programme of operations provided for in Article 10 of the CRD IV.
  • Requirements applicable to shareholders and members with qualifying holdings pursuant to Article 14 of the CRD IV.
  • Obstacles which may prevent effective exercise of the supervisory functions of the Member State competent authority as referred to in Article 14 of the CRD IV.
