On 7 March 2022, the European Commission issued a four week consultation on a draft Implementing Decision on the equivalence of the regulatory framework for central counterparties (CCPs) in Malaysia to the requirements of the European Market Infrastructure Regulation (EMIR).

The draft Implementing Decision provides that for the purposes of Article 25 of EMIR, the legal and supervisory arrangements of Malaysia applicable to CCPs laid down in the Securities Commission Malaysia Act 1993 and the Capital Markets and Services Act 2007, as supplemented by the Securities Commission Malaysia’s Guidelines on Financial Market Infrastructures, shall be considered equivalent to the requirements laid down in EMIR.

The deadline for comments on the consultation is 4 April 2022.
