On 29 November 2019, the European Commission (Commission) adopted two Delegated Regulations containing regulatory technical standards (RTS) for securitisation repositories relating to mandates under the Securitisation Regulation:
- Commission Delegated Regulation on RTS on securitisation repository operational standards for data collection, aggregation, comparison, access and verification of completeness and consistency and Annex. Article 10(7)(a) and 17(2) of the Securitisation Regulation mandates the European Securities and Markets Authority (ESMA) to set out a framework for securitisation repositories to collect, process and provide access to relevant disclosures on securitisations that the originator, sponsor or securitisation special purpose entities are required to make available by means of a securitisation repository; and
- Commission Delegated Regulation on RTS specifying the details of the application for registration of a securitisation repository and the details of the simplified application for an extension of registration of a trade repository. This Delegated Regulation specifies the content of a securitisation repository’s application for registration.
The European Parliament and the Council of the EU will now consider the Delegated Regulation. They will enter into force 20 days after their publication in the Official Journal of the EU.
