The Capital Requirements (Capital Buffers and Macro-Prudential Measures) Regulations 2014 have been published along with an explanatory memorandum.

The Regulations, which were made on 1 April 2014, implement in part the provisions relating to capital buffers in the CRD IV Directive (in particular articles 128, to 142, 160 and 162). The Regulations also make provisions relating to the notification procedure under article 458 of the Capital Requirements Regulation. The Regulations came into force on 3 April 2014, except:

  • Regulations 1 to 3, 7 to 13, 15 to 20, and 36 come into force on 1 May 2014;
  • Regulations 4 to 6, 14, and 21 to 34 come into force on 1 January 2016;
  • Regulation 35 comes into force on 1 May 2014 so far as it relates to the institution-specific countercyclical capital buffer, and 1 January 2016 so far as it relates to the capital conservation buffer and the G-SII buffer.
