There has been published in the Official Journal of the EU (OJ), Commission Delegated Regulation (EU) 2017/323 of 20 January 2017. This Delegated Regulation makes certain corrections to Article 37 of Delegated Regulation (EU) 2016/2251 supplementing the European Market Infrastructure Regulation with regard to regulatory technical standards on risk mitigation techniques for uncleared over-the-counter derivative contracts not cleared by a central counterparty.

In Article 37 of Delegated Regulation (EU) 2016/2251, the provision on applying the phase-in of the variation margin requirements to intra-group transactions in a way analogous to the provision in Article 36(2) (which relates to initial margin requirements) is missing. Delegated Regulation (EU) 2017/323 inserts these missing paragraphs.

Delegated Regulation (EU) 2017/323 enters into force on the day of its publication in the OJ. It applies from 4 January 2017.
