On 3 December 2025, the Australian Securities and Investments Commission (ASIC) updated Regulatory Guide 221 Facilitating digital financial services disclosures (RG 221).
RG 221 explains ASIC’s approach to provisions in Parts 7.7 and 7.9 of the Corporations Act 2001 (Cth) (Corporations Act), the use of digital delivery of financial services disclosures and the relief ASIC has given to facilitate digital disclosures.
RG 221 also sets out the methods financial services providers can use to deliver disclosures digitally, including the method available in ASIC Corporations (Electronic Disclosure) Instrument 2025/447 which involves making the disclosure available digitally and notifying the client that the disclosure is available.
The update follows an earlier consultation (CS 23 Proposals to continue to facilitate digital disclosure) with industry. ASIC received seven non-confidential submissions to its consultation and has summarised the key feedback and ASIC’s responses here.
