On 14 July 2026, the European Commission adopted a Delegated Regulation amending Delegated Regulation (EU) No 149/2013 in relation to clearing thresholds and the mechanisms triggering their review under the European Markets and Infrastructure Regulation (EMIR).
Summary
This Delegated Regulation modifies Delegated Regulation (EU) No 149/2013 by:
- Amending Article 11: to set the clearing thresholds values applicable to aggregate positions for financial counterparties.
- Inserting Article 11a: to set the clearing thresholds values applicable to uncleared positions.
- Inserting Article 11b: to devise the mechanisms triggering a review of the values of the clearing thresholds.
Next steps
If neither the Council of the EU and the European Parliament object following scrutiny, the delegated regulation will be published in the Official Journal of the EU and come into force 20 days after publication.
