Consultations
The four consultation papers cover draft:
- Implementing technical standards (ITS) on depositor information per the mandate given to the EBA under Article 16 of the DGSD3. These draft ITS set out harmonised content and formats for depositor information sheets provided at account opening, and on a regular basis. They also establish requirements for communications to depositors in specific situations, such as bank mergers, or failures.
- ITS on information exchange per the mandate given to the EBA under Article 16a of the DGSD3. These draft ITS introduce standardised procedures, templates and minimum requirements for information exchange in bank failure scenarios. They also enhance reporting from DGSs to the EBA on covered deposits and available financial means and improve transparency on the use of DGS funds.
- Regulatory technical standards (RTS) on client funds per the mandate given to the EBA under Article 8b of the DGSD3. The draft RTS establish rules to ensure that DGSs receive the data needed to identify and reimburse clients whose funds are held in intermediary accounts. They also clarify when reimbursement should be made directly to clients or via the account holder and how to prevent duplicate payouts.
- Guidelines on investment of available financial means per the mandate given to the EBA under Article 10(13) of the DGSD3. The draft guidelines set out how DGSs should invest their funds to ensure diversification, low risk and sufficient liquidity.
