On 16 December 2025, there was published on Legislation.gov.uk The Financial Services and Markets Act 2023 (Prudential Regulation of Credit Institutions) (Consequential Amendments) Regulations 2025 together with an explanatory memorandum.

These Regulations come into force on 1 January 2025.

These Regulations:

  • Commence, from 1 January 2026, the revocation of certain provisions of the UK Capital Requirements Regulation.
  • Amend section 3 of the Banking Act 2009 (the Banking Act), which sets out how certain definitions in the Banking Act should be interpreted and makes certain amendments including to the definition of Common Equity Tier 1 instruments.
  • Amend the definition of “response period” in articles 64(2) and 68(2) of the Bank Recovery and Resolution (No. 2 Order) 2014.
  • Amend regulation 7(6) of the Financial Conglomerates and Other Financial Groups (Amendment etc.) (EU Exit) Regulations 2019.
  • Amends the definition of “relevant requirement” in regulation 2 of the Bank Levy (Loss Absorbing Instruments) Regulations 2020.
