On 13 August 2025, the Single Resolution Board (SRB) published a consultation on its operational guidance for banks on separability and transferability of transfer tools, specifically in the form of share or asset deals.
Overview
The purpose of the consultation is to provide operational guidance for banks to demonstrate their capabilities to support the successful implementation of transfer tools during resolution. The consultation has been published simultaneously with, and is complemented by the Operational Guidance on Transfer Playbooks.
Consultation
To summarise the consultation on operational guidance includes general considerations on: the necessary and conditional criteria for the identification of the transfer perimeter, the separability and transferability assessment for institutions to conduct subject to national legislation, marketability assessments and expectations for institutions when proposing a list of suitable potential purchasers and implementation for management of information systems and data-capabilities.
Next steps
The deadline for comments on the consultation is 22 October 2025.
The SRB will meet the banking industry and other relevant stakeholders in September to address any questions before the consultation period ends.
