On 31 July 2025, the European Banking Authority (EBA) issued a consultation paper containing draft implementing technical standards (ITS) for the supervisory reporting of third-country branches (TCBs) under the Capital Requirements Directive (as amended).

Background

The Capital Requirements Directive VI (CRD VI) introduces a new framework for TCBs and in particular Article 48k of this Directive outlines the regulatory and financial information that TCBs must periodically report to Member State competent authorities (NCAs). In addition, Article 48I(1) mandates the EBA to develop draft ITS to define uniform formats, definitions, and reporting frequencies for these requirements. While some of these reporting obligations are not entirely new – having already been included in CRD V – CRD VI introduces new elements. These include requirements for TCBs to report information about their head undertakings (HUs), as well as details on originated assets and liabilities.

Templates

In the consultation paper the EBA puts forward draft ITS, proposing two sets of templates: information requirements concerning the TCBs themselves and information requirements regarding their HU. In both cases, the entities obligated to report are always the supervised TCBs. Proportionality is addressed through a “core + supplement approach” applied to Class 1 and Class 2 TCBs, with a core set of data points applicable to all TCBs and additional information required only for those classified as Class 1.

Next steps

The deadline for comments on the consultation paper is 31 October 2025.

A public hearing on the draft ITS will take place on 5 September from 10:00 to 12:00 CEST. The deadline for registration is 2 September 2025, 16:00 CEST.

Following the consultation the EBA expects to finalise the draft ITS and submit them to the European Commission by 10 January 2026.

The first reference date for the application of the draft ITS is anticipated to December 2026, so as to grant NCAs and TCBs to have an implementation period of approximately one year.
